Terms of Use
These Terms of Use govern your use of somethingworthwaitingfor.com (the “Service”). Please read them carefully before creating an account or placing an order.
1. Who we are
The Service is provided by Something Worth Waiting For, trading as Something Worth Waiting For (“we”, “us” and “our”).
You can contact us at [email protected].
2. The Service
Something Worth Waiting For lets you write a digital letter, choose a delivery date or delay, and ask us to send it electronically to the recipient you specify. The Service is not a postal, legal, financial, emergency or secure-document service. Do not use it to send time-critical, confidential, legally binding, health, financial, identity or emergency communications.
You are responsible for checking all letter content, recipient details and selected delivery timing before submitting an order. Delivery times are estimates only: a scheduled letter may be affected by technical maintenance, delivery-provider availability, spam filtering or circumstances outside our control.
3. Accounts
You must provide accurate account information, keep your password confidential, and tell us promptly if you suspect unauthorised use. You must be at least 18 years old, or have the permission of a parent or guardian, to use paid features.
We may suspend or close an account where we reasonably believe these Terms have been breached, an account is fraudulent or abusive, or this is necessary to protect the Service, its users or others.
4. Your letters and acceptable use
You retain ownership of the content you create. You give us a limited, non-exclusive licence to store, process, format and transmit that content only as needed to provide, secure and improve the Service.
You must not use the Service to send or create content that is unlawful, threatening, harassing, hateful, defamatory, sexually exploitative, discriminatory, deceptive, infringing, malicious, or otherwise harmful; to impersonate someone; to collect data unlawfully; or to distribute malware, spam or unsolicited marketing.
You confirm that you have the rights and permissions needed for anything you submit, including any personal information about a recipient. We may remove content or prevent delivery where reasonably necessary to comply with law, enforce these Terms, or protect people or our systems.
5. Orders, prices and payment
Prices and applicable taxes are shown before you place an order. Payment is taken by our payment provider, currently Stripe. By submitting an order, you authorise the applicable payment to be taken. We may correct obvious pricing or description errors and, if an error affects your order, will contact you before proceeding where reasonably possible.
Any subscription renews on the stated billing cycle until cancelled. You may cancel future renewals through your account or by contacting us before the next billing date. Cancellation does not normally refund a period already paid for.
6. Cancellation and refunds
If you are a consumer in the UK or EU, you may usually have a 14-day right to cancel a digital-service purchase. However, where you ask us to begin providing the Service immediately—such as storing, preparing or scheduling your letter—you acknowledge that the service may begin during that period. Where digital content is supplied immediately, we will obtain the consent required by law before your cancellation right is affected.
Once a letter has been sent, it cannot be recalled and is not refundable merely because the recipient does not receive, read or respond to it. If a technical fault prevents us from providing a paid service, contact us at [email protected] and we will investigate and, where appropriate, re-send, credit or refund the affected order.
7. Intellectual property
We and our licensors own the Service, its branding, design, software and other materials, except for content you submit. You may use the Service for your personal, lawful purposes. You must not copy, reverse engineer, rent, sell, scrape, interfere with or exploit any part of it except as permitted by law or with our written permission.
8. Availability and liability
We aim to keep the Service available and reliable, but cannot guarantee that it will always be uninterrupted, secure or error-free. We may change, maintain or withdraw features where reasonably necessary.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights. Subject to that, we are not liable for indirect or consequential loss, loss of profit, business, goodwill or data, or loss arising from a recipient’s actions or an email provider’s filtering. Our total liability for a claim relating to a paid order is limited to the amount you paid for the affected order in the 12 months before the event giving rise to the claim.
9. Changes to these Terms
We may update these Terms from time to time. The current version will be published here with its effective date. If a material change affects an active paid service, we will give reasonable notice where practicable.
10. Governing law
These Terms are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction, except that consumers may bring claims in the courts of the part of the UK in which they live where applicable law permits.
11. Contact and complaints
Please contact us first at [email protected] so we can try to resolve any concern. Nothing in these Terms affects your legal rights.
